Reorganization, liability and succession
Both big corporations and SMEs are confronted with capital losses and liquidity bottlenecks – even in favourable economic conditions. Bankruptcy notices and liability suits against those in charge quickly follow. Often, reorganisation and restructuring are the last hope. Are you prepared for such an unpleasant case, and would you be able to master it competently? Would you be in a position to instruct and control your lawyers properly? Such situations, in particular, which are cumbersome in terms of both time and emotions, require you to understand the legal language and the mechanisms to be applied. You will learn the distinction between capital loss and over-indebtedness, and the legal consequences connected with both. You will understand the conditions under which an executive is liable for mismanagement. And finally, you will be aware of the requirements for bankruptcy to be deferred and what it takes for a successful reorganisation.
Also, when it comes to the transfer of shareholdings in SMEs and family businesses, the succession should always be kept in mind and prepared for early on and properly. In this connection the relevant questions to be addressed concern company law, tax law, matrimonial law and inheritance law. Participants will be provided with an extensive overview of the entire range of issues. They will learn to assess what is relevant, be able to answer initial questions competently themselves and understand when they should consult experts.

Fees
CHF 4,600
Course fees include materials, break refreshments and lunch. Participants must pay the additional costs for other meals, travel and accommodation.
